• No Endorsement or Guarantee: We do not endorse, guarantee, or verify the quality, safety, legality, or effectiveness of any teacher, student, service, or lesson arranged through the Site.
• Independent Parties: All teachers and students act as independent parties, and are solely responsible for their own conduct, qualifications, and services.
• No Liability: We are not responsible for disputes, cancellations, missed lessons, payments, injuries, damages, or any outcomes of interactions between teachers and students.
• Payments: Any financial transactions or agreements made between teachers and students are independent of HappyMusicMatch. We are not responsible for payment disputes or refunds.

By using the Site, you acknowledge that any engagement with teachers or students is at your own risk, and you agree to release HappyMusicMatch and its staff from all liability related to such interactions.

6. Minors Policy

The safety and protection of minors is a priority. By using this Site, you agree to the following terms regarding students under the age of 18 (“Minors”):

• Parental/Guardian Responsibility: All Minors must have a parent or legal guardian manage or approve their account, lesson arrangements, and communications with teachers.
• Teacher Compliance: Teachers are solely responsible for complying with all applicable laws and regulations regarding working with Minors, including but not limited to background checks, mandatory reporting, and child protection requirements in their jurisdiction.
• No Supervision by HappyMusicMatch: We do not monitor lessons, communications, or interactions between teachers and students, including Minors. It is the responsibility of parents/guardians to supervise and ensure safe learning environments.
• Release of Liability: HappyMusicMatch, its owners, and staff are not liable for any disputes, misconduct, claims, or damages arising from lessons involving Minors.

By permitting a Minor to use the Site, parents or legal guardians agree to assume full responsibility for the Minor’s use of the Site and all resulting consequences.

7. Third-Party Links and Services

The Site may contain links to third-party websites or services. These are provided solely as a convenience and do not constitute an endorsement. We are not responsible for the content, accuracy, or practices of any third-party site. Accessing third-party websites is at your own risk.

8. No Professional Advice

The content provided on the Site is for informational purposes only. It does not constitute professional, legal, financial, medical, or educational advice. You are responsible for seeking professional guidance where appropriate.

9. Disclaimer of Warranties

12. Arbitration and Dispute Resolution

• Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to this Agreement or your use of the Site shall be resolved through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if eligible.
• Waiver of Class Actions: You agree that disputes will be resolved only on an individual basis and not as part of a class, consolidated, or representative action.
• Governing Rules: Arbitration shall be conducted under the rules of the American Arbitration Association (AAA) or another recognized arbitration body agreed upon by both parties.
• Location: Unless otherwise required by law, arbitration shall take place in Wilmington, Delaware.
• Costs: Each party shall bear its own arbitration costs and attorney fees, except where applicable law provides otherwise.

By agreeing to arbitration, you waive the right to a trial by jury or to participate in a class action.

13. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Delaware, United States. Except as provided under Arbitration, you agree to submit to the exclusive jurisdiction of the courts located in Wilmington, Delaware for the resolution of any disputes.

14. Termination

We may suspend or terminate your access to the Site at any time, with or without cause, and without prior notice. Upon termination, your right to use the Site immediately ceases.

15. Severability

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
